Terms and Conditions

 

  1. These are the Terms and Conditions applicable to the 60-day Money Back Promise promotion (“Promotion”) by SharkNinja Singapore Pte. Ltd. (“SharkNinja”). These terms and conditions are separate and in addition to any other terms which may be applicable to you in relation to your purchase of SharkNinja products, including our Terms of Service, our standard Warranty terms, and also our Refund Policy.
  1. In order to enjoy this Promotion, you must accept these Terms and Conditions. This Promotion is provided on a complimentary basis in addition to any existing warranty that may be accompanied with your purchase of SharkNinja products. Subject to applicable law, SharkNinja reserves the right to amend, change or revert these Terms and Conditions from time to time at its discretion, and if SharkNinja do so, SharkNinja will notify you of any changes by any reasonable means, including by posting the revised terms (or a link to the revised terms) on our website. 
  1. You agree to comply with instructions issued by SharkNinja on participating and signing up for this Promotion.
  1. This Promotion is open to Singaporean residents of 18 years and above, except those employees (and their immediate families) of SharkNinja, retailers and agencies associated with this Promotion are ineligible to enjoy this Promotion. 
  1. This Promotion is only valid for purchases of all SharkNinja eligible appliances through SharkNinja authorized channels. (“Eligible Appliances”).  
  1. To be eligible for a refund under our Promotion:(i) a Eligible Appliance must have been used under normal household conditions and maintained according to the instructions supplied by SharkNinja that accompanies the appliance; and (ii) the Eligible Appliance must not be subject to any hire purchase, lease, rental or other agreement, a result of which being that another party has an interest in or charge over the Eligible Appliance.  You must produce such records or information as is reasonably required by SharkNinja to establish that you are eligible for a refund.
  1. In order to claim a refund under our Promotion, the Eligible Appliance returned must be accompanied with all machine and tools, undamaged, in full working order, in original packaging and with original proof of purchase. This Promotion does not alter any other statutory rights you may have to a refund.  
  1. In order to claim a refund under our Promotion, you must (i) submit the appropriate form on our website, sharkninja.sg (as applicable) within 60 days of your purchase; and (ii) opt in and agree that SharkNinja may use your personal data for processing the refund and also for marketing purposes (see details in Clause 15 below).
  1. To the extent permissible by law, it shall be your sole responsibility to arrange and pay for any charges associated with the delivery and return of the Eligible Appliance to Singapore Shark Ninja’s DHL Centre at Singapore DHL Supply Chain Singapore Pte Ltd, Tampines LogisPark 1, Greenwich Drive, ARC Warehouse Block 1, Level 3 Loading Bay 21, 22, 23 Singapore 533865.

 Alternatively, SharkNinja can arrange pick-up of the Eligible Appliances by a third party for SGD 20.00 charge.  SharkNinja accepts no responsibility for the loss or damage of the Eligible Appliance during its return (whether such return is arranged by yourself or us), which is at your sole risk until received by SharkNinja.

After two failed attempts in collecting the Eligible Appliance from the customer, the customer would need to pay SGD20.00 charge again.

  1. SharkNinja shall have the absolute discretion to determine whether you have satisfied these terms, in order to be eligible for a refund under this Promotion.  
  1. If SharkNinja determines that you are eligible for a refund under this Promotion, you will be notified. The refund amount will then be sent to you within to up 60 days from the date of notification, by way of wired transfer.
  1. Refund will only be addressed to the name of the requester of Money Back Promise.  
  1. Except for any liability that cannot be excluded by law, SharkNinja excludes all liability (including negligence), for any personal injury; or any loss or damage; whether direct, indirect, special or consequential, arising in any way out of this Promotion , including any claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by SharkNinja) due to any reason beyond the reasonable control of SharkNinja.  
  1. Certain legislation may imply warranties or conditions or impose obligations upon SharkNinja which cannot be excluded, restricted or modified except to a limited extent. These Terms and Conditions must be read subject to those statutory provisions. If those statutory provisions apply, to the extent to which SharkNinja is able to do so, its liability will be limited, at its option to (i) the replacement of the goods or the supply of equivalent goods; (ii.) the repair of the goods; (iii) payment of the cost of replacing the goods or acquiring the goods or acquiring equivalent goods; or (iv) payment of the cost of repairing the goods.
  1. SharkNinja collects, use and processes personal data in order to conduct this Promotion and may, for this purpose, disclose such data to third parties, including but not limited to agents, contractors, service providers, offer suppliers and as required, to Singapore regulatory authorities. SharkNinja may also use such data for promotional, marketing, publicity, research and profiling purposes, based on your communication preferences stated in your Claim Form. Your participation in this Promotion is conditional on your provision of such data and your consent for such data to be used for such purposes. All personal data will be handled by SharkNinja in accordance with SharkNinja's Privacy Policy.
